The licensing officer presented their report. Members had no questions for the licensing officer.
The applicant and their legal representative addressed the sub-committee. Members had questions for the applicant and their legal representative. On questioning, the applicant advised that they would use delivery bicycles, not mopeds or cars, for the purpose of delivering their food to customers.
The trading standards officer addressed the sub-committee. Members had questions for the trading standards officer.
The local resident, objecting to the application, addressed the sub-committee.
All parties were given five minutes for summing up.

That the application made by Mr Nick Stratton or a premises licence to be granted under the Licensing Act 2003 in respect of the premises known as Pizza Pick Up, 64 Peckham Rye, London SE15 4JR is granted as follows:

Conditions
The operation of the premises under the licence shall be subject to relevant mandatory conditions, conditions derived from the operation schedule highlighted in Section M of the application form, the conciliated conditions agreed with the responsible authorities and the following additional conditions agreed by the sub-committee:
1. That there shall be no unaccompanied children on the premises at any time after 20:00.
2. That off-sales are limited to collection of substantial meals from the premises. All persons collecting are subject to the Challenge 25 scheme.
3. That the collection of waste from the premises shall only take place between 08:00 and 20:00.
4. That no alcohol shall be supplied in the home delivery service.
5. That alcohol shall not be sold or supplied on the premises otherwise than to persons taking substantial table meals.
Reasons
The reasons for the decision are as follows:
The licensing sub-committee heard from the applicant and their representative who advised that this would be a small pizza restaurant with 30 covers and that alcohol would be sold as ancillary to food.
They confirmed that they had conciliated with the police and public health and had agreed to the majority of the conditions suggested by trading standards.
The applicant sought to address the concerns raised by the local residents by assuring the sub-committee that the premises would be operated in a responsible and professional manner. In seeking to address these concerns, the applicant assured the sub-committee that they would seek to regulate smokers leaving the premises in order to minimise impact on residents. They also agreed to ensure that waste collections were restricted to specific times in order to reduce any noise and nuisance impact.
They confirmed that they had reduced the hours sought and had removed regulated entertainment and non-standard hours from the application.
The sub-committee noted that the police and public health authority had conciliated with the applicant.
The trading standards officer addressed the sub-committee in respect of the prevention of children from harm licensing objective. The officer stated that their representation was in relation to the original application with extended hours. The officer suggested conditions in order to ensure the responsibility from the applicant as to the time and level of supervision in respect of children attending the premises.
The sub-committee noted that one of the local residents (party 1) had withdrawn their representation.
The licensing sub-committee noted the remaining representations from three local residents, one of whom attended and made oral representations. The resident raised specific concerns about the bin collections and requested restrictions on waste collection times. The resident also raised concerns about noise and smokers in the area.
The licensing sub-committee considered all of the oral and written representations before it and were satisfied that the conciliated conditions and the additional conditions imposed at the meeting today would assist the applicant in operating the premises in a responsible manner and in accordance with the licensing objectives.
In reaching this decision the sub-committee had regard to all the relevant considerations and the four licensing objectives and considered that this decision was appropriate and proportionate.
Appeal rights
The applicant may appeal against any decision:
a) To impose conditions on the licence
b) To exclude a licensable activity or refuse to specify a person as premises supervisor.
Any person who made relevant representations in relation to the application who desire to contend that:
a) The licence ought not to be been granted; or
b) That on granting the licence, the licensing authority ought to have imposed different or additional conditions to the licence, or ought to have modified them in a different way
may appeal against the decision.
