Minutes:
As the premises user and the police had advised they had conciliated, during the discussions that took place during item 5 of this meeting, the sub-committee agreed that they would consider their decisions for item 5 and this item together.
RESOLVED:
That a counter notice not be issued under Section 105 of the Licensing Act 2003 in respect of the temporary event notice (TEN) served by Mr Taz Uddin, in regards to an event to be held at Blue Eyed Maid, 173 Borough High Street, SE1 1HR between 00:01 on 30 August 2015 and 06:00 on 30 August 2015.
Conditions
That all of the existing conditions of the premises licence shall apply with the following exception:
Condition 808 which shall be modified to read “That there be no entry or re-entry to the premises after 03.00, with the exception of smokers”.
Reasons
This was a temporary event notice given by the premises user, Mr Taz Uddin, in regards to an event to be held at Blue Eyed Maid, 173 Borough High Street, SE1 1HR between 00:01 on 30 August 2015 and 06:00 on 30 August 2015.
The sub-committee heard from the premises user (the applicant) and the police representative who both advised that they had conciliated the above conditions prior to this meeting. The police confirmed that in their opinion that these conditions would be appropriate and proportionate in order to promote the licensing objectives.
In reaching this decision the sub-committee had regard to all the relevant considerations and the licensing objectives and felt that the conditions were appropriate and proportionate in order to address the licensing objectives.
Appeal rights
Where the relevant counter notice under Section 105(3) is given the premises user may appeal against the decision. Where counter notice is not given, the chief officer of police or the environmental protection team may appeal against that decision. The appeal must be made to the Magistrates’ Court within a period of 21 days beginning with the day on which the applicant was notified by the licensing authority of the decision to be appealed against. No appeal may be brought later than five working days before the day on which the event begins.
