Minutes:

The licensing officer presented their report.  The licensing officer advised that all representations had been withdrawn.  Members had no questions for the licensing officer.

 

The trading standards officer advised that they had now withdrawn their representation.  Members had no questions for the trading standards officer.

 

The applicant and their legal representative addressed the sub-committee.  They confirmed that they were satisfied with the agreement with trading standards.  The applicant also advised that they were happy to waive their appeal rights in order that the licence could be in place with immediate effect.  Members had no questions for the applicant.

 

The members of the sub-committee agreed that they were satisfied with the application as conciliated.

 

RESOLVED:

 

That the application made by SomchaiSungprapai for a premises licence, granted under the Licensing Act 2003 in respect of the premises known asLombok Thai, 17 Half Moon Lane, London SE24 9JU be granted as follows:

Conditions

 

The operation of the premises under the licence shall be subject to relevant mandatory conditions, conditions derived from the operation schedule highlighted in Section M of the application form and the conditions agreed with the Metropolitan Police Service and the trading standards authority during the conciliation process.

 

Reasons

 

The reasons for the decision are as follows:

 

The licensing sub-committee heard from the applicant and their legal representative who confirmed that they had agreed to several conciliated conditions with the police and trading standards.

 

Trading standards advised that, following the applicant agreeing to the challenge 25 conditions proposed by trading standards officers, they had now withdrawn their request for the following conditions:

 

1.  That no children shall be on the premises after 22.30

 

2.  That between 21.00 and 22.30 children shall be accompanied and supervised by a responsible adult.

 

The licensing sub-committee granted the application following the withdrawal of representations by the Herne Hill Society and the Dulwich Society subject to the conciliated conditions agreed with the responsible authorities. The sub-committee was satisfied that these conditions dealt with the written representations from other persons.

 

In reaching this decision the sub-committee had regard to all the relevant considerations and the four licensing objectives and considered that this decision was appropriate and proportionate.

 

Appeal rights

 

The applicant through their representative confirmed to the sub-committee that they waived their right to appeal the decision.
