Licensing Act 2003: Londrino Restaurant, 36 Snowsfields Yard, London SE1 3QQ

Minutes:

The licensing officer presented their report. Members had no questions for the licensing officer.

 

The applicants and their legal representative addressed the sub-committee.  Members had questions for the applicants and their legal representatives.

 

The meeting went into closed session at 10.38am.

 

The meeting resumed at 10.46am and the chair read out the decision of the sub-committee.

 

RESOLVED:

 

That the application made by Respite Management for a premises licence to be granted under the Licensing Act 2003 in respect of the premises known asLondrino Restaurant, 36 Snowsfields Yard, London SE1 3QQ be granted as follows:

 

Licensable activity

Hours

 

The supply of alcohol (on and off premises)

Sunday to Wednesday from 10:00 to 23:30

Thursday to Saturday from 10:00 to 00:00

 

Seasonal variation

From the terminal hour on New Year's Eve to the commencement of regulated hours the following day. Sundays prior to Bank Holidays to be treated as Saturdays for the purposes of regulated hours and activities.

Non-standard timings

Off sales only in a sealed container and only until 23:00.

 

The provision of late night refreshment (indoors):

 

Sunday to Wednesday from 23:00 to 00:00 (midnight)

Thursday to Saturday 23:00-00:30 (the following day)

Opening hours

 

Sunday to Wednesday from 09:00 to 00:00 (midnight)

Thursday to Saturday08:00 to 00:30 (the following day)

 

Conditions

 

The operation of the premises under the licence shall be subject to relevant mandatory conditions, conditions derived from the operation schedule highlighted in Section M of the application form, the conditions agreed with the Metropolitan Police Service and the licensing authority during the conciliation process and the conditions agreed by the sub-committee:

 

1.  That the accommodation limit for the inside area of the premises shall not exceed 100 people excluding staff.

 

2.  That the accommodation for the outside area of the premises as indicated on the plans shall not exceed 20 people excluding staff.

3.  That in the informal area to the right of the entrance hatched on the plans, customers shall be seated and served with substantial food available save for up to 12 persons waiting for a table.

 

4.  That alcohol shall be supplied only to those seated and taking a table meal in the formal dining area to the left of the left of the entrance on the plans.

 

5.  That off sales of alcohol shall be sold in closed containers and taken away from the premises.

 

6.  That clear legible signage shall be prominently displayed where it can be easily seen and read, requesting that alcohol sold as “off sales” should not be opened and consumed in the vicinity of the premises.

 

7.  That clear legible signage shall be prominently displayed where it can be easily seen and read, requesting that customers leave the area in a quiet and orderly manner.

 

8.  That the dispersal policy provided shall be kept at the premises with the licence and made available for inspection by authorised officers.

 

9.  That there will be no more than eight smokers permitted in the dedicated smoking area located outside the plant room access and no drinks are permitted outside.

 

10.  That the premises provide a dedicated telephone number for local residents.

 

11.  That the operation of the external area cease at 22:00.

 

Reasons

 

The licensing sub-committee heard from the applicant who advised that the premises sit in a busy mixed use commercial area very close to the iconic Shard.Whilst the premises are just within the Borough cumulative impact area, we respectfullysubmit that it should not contribute to any concerns with the licensing objectives ascustomers will be seated and served, and dining at different times. The new restaurantand bar will contribute to the excellence of Southwark's food and drink facilities.

 

The formal restaurant area is to the left of the entrance with a seasonal terrace. To theright is an informal area for lighter snacks and drinks without the need for a full mealwhere customers will be seated and served by waiter or waitress. We would requestup to 12 persons to be able to stand at the bar whilst waiting for a table. There will notbe any regulated entertainment, only background recorded music

 

The licensing sub-committee noted that the both the Metropolitan Police Service and licensing as a responsible authority had conciliated with the applicant (conditions 1 to 8, above).

 

The licensing sub-committee noted the written representations from the eight other persons.

 

The licensing sub-committee considered all of the oral and written representations before it and were satisfied that the conciliated conditions together with the three additional conditions imposed by this sub-committee (conditions 9 to 11 above) sufficiently satisfied all of the local residents concerns.

 

In reaching this decision the sub-committee had regard to all the relevant considerations and the four licensing objectives and considered that this decision was appropriate and proportionate.

 

Appeal Rights

 

The applicant may appeal against any decision:

 

a)  To impose conditions on the licence.

b)  To exclude a licensable activity or refuse to specify a person as premises supervisor.

 

Any person who made relevant representations in relation to the application who desire to contend that:

 

a)  The  licence ought not to be been granted; or

b)  That on granting the licence, the licensing authority ought to have imposed different or additional conditions to the licence, or ought to have modified them in a different way

 

may appeal against the decision.

 

Any appeal must be made to the Magistrates’ Court for the area in which the premises are situated. Any appeal must be commenced by notice of appeal given by the appellant to the justices’ clerk for the Magistrates’ Court within the period of 21 days beginning with the day on which the appellant was notified by the licensing authority of the decision appealed against.
